Following a very busy March preparing, testing and distributing our latest release of CDM ToolKit CS™ which is now fully updated for the CDM 2015 regulations, April has been a very interesting month so far.
Since the new CDM regulations were introduced on 6th April, we have been helping customers update their processes and template documentation in-line with the changes required for the new regulations. It's upon us ready or not and, no matter what your role, you should be embracing your duties in respect of all new projects.
The difficulty is, of course, that many of us may not know what our duties are or fully understand what they require of us, whether they be Duties imposed on Clients or on Designers and, in particular, Principal Designers. We will, however, find it difficult to base a defense against any charge, be it criminal prosecution, enforcement notice or fees for intervention, on the grounds that we were unaware of the extent of our Duties under the new legislation.
The Duties imposed on both the Client and the Principal Designer are fraught with risk for the unwary because they do not just take the Duties of the former CDM Co-ordinator and share them around, they build on them in terms of the extent to which they apply and introduce new duties in some instances.
