The recent Fairchild Case (Feb 2001) where 3 sufferers had judgements for damages quashed by the appeal court in London over the fatal fibre argument has now been reviewed by the House of Lords in London. The judgement by Lord Bingham has ruled that the appeal judgement supporting the fatal fibre argument has been overturned. This opens the way for several hundred asbestosis and similar cases to be put through courts with average awards against employers expected to reach about £100,000.
