Key health and safety issues are referred to but not defined in the regulations, however, the way in which the construction phase will be managed and the key health and safety issues for the particular project must be set out in writing in the construction phase plan.
These issues are deemed to be in addition to any that the contractor can reasonably be expected to be aware of by virtue of their competence as contractors.
It follows therefore that any issue should be included in the plan which provides a significant risk to the health & safety of any personnel in the vicinity of the construction site AND which a competent contractor would be unaware of unless he was told about it.
