The CDM 1994 ACoP included a definition of Great Britain's territorial sea; normally extends 12 nautical miles from the low water mark. Special provision is made where there are estuaries and bays. The territorial sea defines the geographical limits for the CDM Regulations. Although the territorial issue is complicated, it does not make any significant difference to construction in practice. Gibraltar, Northern Ireland etc. are not in the scope. They are not part of Great Britain and have their own version of CDM, etc.
If the construction takes place within the territorial sea it may be assumed that the CDM 2015 Regulations apply to the project irrespective of where any of the personalities involved in the construction process are located outside that area.
