Health and Safety (Enforcing Authority) Regulations 1998
Legislation
These Regulations determine whether the HSE or the Local Authority inspectors are responsible for enforcing health and safety legislation. The legislation states that the HSE is responsible for all notifiable CDM work and all the requirements of CDM.
The legislation also states that the HSE is the enforcing authority for minor construction work (see below) in all premises for which the local authority is the enforcing authority. Local Authorities are the Enforcing Authority for construction work carried out certain persons who either work on the premises or if they do not, still fall within the legislation's requirements because certain aspects of the work being carried out. These requirements are listed in the legislation and should be referred to in detail there.
The minor work that is excluded is summarised here for convenience. However, the legislation contains detail that should be referred to if this may be applicable to the user:
- Consumer services provided in a shop
- Sale of goods, storage of goods for retail or wholesale distribution
- Catering services
- Office activities
- Launderettes
- Undertaking services
- Care / accommodation / exhibition of animals
- Sites for accommodation including caravans and campers
- Display / demonstration of goods at an exhibition
