The Construction (Design and Management) Regulations 2015 require that all construction sites must provide sufficient and suitable welfare facilities for the construction workers. Such facilities may be those of the client, where they exist and where permission has been given that construction workers may use them, or they may be portable facilities provided by the contractor.

In either case it is important that a record is kept of the facilities provided. The facilities to be provided include clean drinking water, washing facilities, hot water, toilet facilities, facilities for taking breaks and meals and facilities for storing and changing clothing. All these must be maintained in a clean and hygienic condition.

All contractors have a duty under the CDM regulation 15 that suitable welfare facilities are provided for their employees and sub-contractors, as follows:

  1. A contractor must ensure, so far as is reasonably practicable, that the requirements of Schedule 2 are complied with so far as they affect the contractor or any worker under that contractor's control.

The client, under CDM regulation 4, the client must ensure that suitable arrangements for the site welfare facilities required by Schedule 2 are provided in respect of any person carrying out construction work.

Schedule 2 Welfare facilities

The requirements for the welfare facilities are contained within Schedule 2 of the CDM regulations, for:

  • Sanitary conveniences
  • Washing facilities
  • Drinking water
  • Changing rooms and lockers
  • Facilities for rest
